BY SIGNING THIS DOCUMENT, YOU WILL WAIVE LEGAL RIGHTS INCLUDING THE RIGHT TO SUE NORTH BELLINGHAM GOLF COURSE OR ANY OF ITS PRINCIPALS

I hereby certify that I am at least 18 years of age (or, if less than 18 years of age, have caused this Liability Waiver and Release to be signed by my parent or legal guardian).

I, the undersigned, wish to participate in sporting activities at the North Bellingham Golf Course (“NBGC”) located at 205 W. Smith Rd., Bellingham, WA 98226. The sporting activities include playing golf, driving or riding in NBGC’s golf carts, traversing or being located on NBGC’s property, and any other physical and recreational activities as may be available at NBGC (collectively the “Activities”). I hereby assume all risks in engaging in the Activities and am aware there will be other golfers at NBGC who, in the course of engaging in the Activities themselves, may pose a risk to my person or property. I hereby defend, hold harmless and release NBGC, including its members, managers, employees, agents, representatives, and principals (collectively the “Releasees”), and indemnify NGBC and the Releasees, from and against any and all losses, claims, cause of actions, lawsuits, damages, costs, or expenses whatsoever arising out of or related to my engagement in the Activities, including but not limited to injury to my person or property caused by the negligent acts and/or omissions of NBGC and the Releasees. 

To the extent allowed by law, I hereby expressly waive and release any and all claims, now known or hereafter known, against the Releasees on account of injury, disability, death, or property damage arising out of or attributable to my participation in the Activities, whether arising out of the ordinary negligence of NBGC or any Releasees or otherwise. I covenant not to make or bring any such claim against NBGC or any other Releasee and forever release and discharge NGBC and other Releasees from liability under such claims. 

I further agree to obey all rules and policies of NBGC related to the conduct of its guests and customers and to be financially responsible for any and all damage to NBGC’s property caused by my actions. This Release shall be governed by the laws of the state of Washington, and that any action, claim, or proceeding under this Liability Waiver and Release shall be commenced exclusively in the courts of Washington located in Whatcom County. 

I HAVE READ AND UNDERSTOOD THIS LIABILITY WAIVER AND RELEASE AND I AM AWARE THAT BY SIGNING BELOW, I AM WAIVING LEGAL RIGHTS WHICH I OR MEMBERS OF MY FAMILY, MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, REPRESENTATIVES, SUCCESSORS, AND ASSIGNS MAY HAVE AGAINST NORTH BELLINGHAM GOLF COURSE, ITS MEMBERS, MANAGERS, PRINCIPALS, EMPLOYEES, AGENTS, AND REPRESENTATIVES.
